Welcome to producedbyconference.com (the “Site” or the “Website”), which is operated by 2019 PRODUCED BY: NEW YORK (“the Conference”), the Producers Guild of America Foundation and the Producers Guild of America, Inc. (both entities, the “PGA” and, collectively with the Conference, “we,” “our,” or “us”). This Site is meant to provide information about the Conference to be held at Florence Gould Hall in New York City, NY, November 9, 2019.
We reserve the right to modify the Terms and Conditions, or any part thereof, or add or remove terms at any time. Please check these Terms and Conditions periodically for modifications, additions and/or deletions. Any such modifications, additions or deletions will be effective immediately upon posting. Your use of the Site after such posting will be deemed to constitute acceptance by you of any such changes.
Additionally, we may change or discontinue any aspect, feature or service of the Site at any time.
If you violate any terms of this Agreement, we may terminate your use of the Site, bar you from future use of the Site, forbid you from participating in or attending the Conference, and/or take appropriate legal action.

All content appearing on the Site is the property of the PGA or its licensors or suppliers and is protected under the copyright laws of the United States and/or other countries. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the Site’s content, in whole or in part. You may download copyrighted material for your personal use only, and you acknowledge that you do not acquire any ownership rights by downloading this material. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and that of the copyright owner. Unless otherwise indicated, all names, graphics, designs, logos, page headers, button icons, scripts, commercial markings, trade dress and service names included in the Website (hereinafter “Marks”) are trademarks of the PGA, the Conference, or our licensors, sponsors or suppliers and are protected by the trademark laws of the United States and/or other countries. You may not use, modify, publish, transmit, participate in the transfer or sale of, create derivative works of, or in any way exploit any Marks on this Site without express permission from the owner of the particular Mark.
Community Guidelines and Other Submissions
The Site may contain interactive features such as comment sections, bulletin boards, and discussion forums in which you may post or upload “user content” such as comments, video, photos, messages or other information. You are solely responsible for your use of any of these interactive features, and do so at your own risk..
You agree that you will not engage in any activity on our Site that constitutes a criminal offense or could give rise to civil liability. Further, you warrant and represent that:
- You own the proprietary rights to any user content that you submit;
- Any user content that you submit is not and will not be defamatory or libelous to any party; and

Grant of License to User Content

If you are a California resident, you waive California Civil Code section 1542, which states:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

You agree to indemnify, defend and hold the Conference, the PGA, their officers, directors, agents, employees, volunteers, members, affiliates, successors, assigns, and subsidiaries harmless from any claim, expense or demand, including without limitation reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third-party. You agree that we will not be liable in any way for the accuracy, reliability, or quality of any user content, and that you shall hold us harmless for any errors or omissions in any user content posted by you, or any loss or damage of any kind incurred as a result of the use of any user content posted by you.
You acknowledge and agree that this Agreement shall be governed by and construed in accordance with the laws of the State of California, excluding conflict of laws provisions. You hereby submit to exclusive jurisdiction in the federal and state courts of California, and you agree to expressly waive any claim of improper venue and any claim that such courts are an inconvenient forum.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Section headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
Any failure of ours to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
This Agreement sets forth the entire understanding and agreement between all relevant parties with respect to the subject matter thereof. The provisions of this Agreement will survive termination or expiration to the extent necessary to carry out the intentions of the parties.
The Site may contain links to other websites maintained by third-parties. This Policy does not cover information that may be collected through such third-party sites. If you disclose your personal information to others, different rules may apply to their use or disclosure of the information you disclose to them. No one from the Conference, the PGA, or their officers, directors, agents, employees, volunteers, affiliates, successors, assigns, and subsidiaries are in control of the privacy policies of third-parties, and you are subject to the privacy policies of those third-parties where applicable. In order to register to participate in the Conference and/or view the Conference via live stream video or on-demand (“Registration”), you may be required to provide your personal information. The personal information collected as part of the Registration may include email address, full name, title, phone numbers, fax numbers, addresses, payment information, photos, videos, audio recordings and correspondence sent via the Site.

We also collect and store technical information relating to visitors to our Site, including computer and connection information, IP address, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, and standard web log information.
